Terms of Use

1. Agreement to Terms

By downloading, installing, or using RemindPro ("the App"), you agree to be bound by these Terms of Use ("Terms"). These Terms form a legally binding agreement between you and Esperto.ch ("Developer", "we", "us").

If you do not agree to these Terms, do not use the App. Your continued use of the App constitutes your acceptance of any updates to these Terms.

2. License Grant

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on Apple-branded devices that you own or control, solely for your personal, non-commercial purposes.

3. Free and Premium Tiers

RemindPro offers two tiers:

• Free tier: Includes up to 10 reminders, basic Nag-Me functionality (single nag at 5 minutes), reminder templates, streak tracking, and core notification features.
• Premium tier:Unlocks all features via a one-time in-app purchase ("Lifetime Premium"): unlimited reminders, full Nag-Me engine with custom profiles, Urgent Alarms (AlarmKit), Location Triggers, Apple Watch support, Live Activities & Dynamic Island, Advanced Recurrence, 18 custom notification sounds, Adaptive Timing, iCloud Sync, Siri Shortcuts with custom phrases, and custom snooze durations.

Premium is a one-time, non-subscription purchase processed through Apple In-App Purchase. Once purchased, Premium is associated with your Apple ID and can be restored on any device signed in with the same Apple ID, at no additional charge.

4. Purchases and Refunds

All purchases are made through Apple's App Store via StoreKit 2. Payment is charged to your Apple ID account upon confirmation of purchase. All sales are final, subject to Apple's refund policies. To request a refund, visit reportaproblem.apple.com.

5. Restrictions

You agree not to:

• Copy, modify, or distribute the App or any portion thereof
• Reverse engineer, decompile, or disassemble the App
• Rent, lease, lend, sell, or transfer the App to any third party
• Use the App for any unlawful, harmful, or fraudulent purpose
• Attempt to bypass or circumvent the Premium license verification
• Remove, alter, or obscure any proprietary notices in the App

6. Intellectual Property

The App, including all content, features, code, design, graphics, and sounds, is owned by Esperto.ch and is protected by copyright, trademark, and other intellectual property laws. You are granted no rights to the App's intellectual property except as expressly stated in these Terms.

7. Notifications and System Permissions

The core functionality of RemindPro depends on iOS notification permissions. If you deny or revoke notification permissions, reminders will not be delivered and the Nag-Me engine will not function. This is a technical limitation of iOS, not a defect in the App.

For Location Triggers (Premium), "Always" location permission is required for background geofencing to work. You grant this permission explicitly and can revoke it at any time in iOS Settings.

Urgent Alarms use Apple's AlarmKit framework and require the user to explicitly allow this functionality when prompted by iOS. Urgent Alarms may break through Do Not Disturb and silent mode per Apple's platform rules.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, or free of viruses. Notification delivery depends on iOS, device settings, battery state, and network conditions beyond our control. We make no guarantee that every reminder will be delivered at exactly the scheduled time.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ESPERTO.CH BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, BUSINESS, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP (IF ANY) IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated by reference into these Terms.

11. Third-Party Services

The App integrates with the following Apple platform services:

• Apple StoreKit 2 (in-app purchases)
• Apple iCloud / CloudKit (data sync, Premium)
• Apple HealthKit (health data logging, optional)
• Apple Core Location (location triggers, Premium)
• Apple AlarmKit (urgent alarms, Premium)
• Apple App Intents / Siri (voice shortcuts)
• Apple ActivityKit (Live Activities, Premium)
• Apple WatchConnectivity (Apple Watch, Premium)

Use of these services is subject to Apple's Terms of Service and Privacy Policy.

12. Maintenance and Support

Support for RemindPro is provided by Esperto.ch at info@esperto.ch. Apple has no obligation to provide maintenance or support for the App.

13. Termination

These Terms are effective until terminated. Your rights under these Terms terminate automatically if you fail to comply with any of these Terms. Upon termination, you must stop using the App and delete all copies from your devices. Sections 6, 8, 9, and 14 survive termination.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of Switzerland, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Switzerland.

15. Changes to Terms

We reserve the right to update these Terms at any time. Material changes will be communicated through an App update or in-app notice. Continued use of the App after such changes constitutes acceptance.
